Terms and Conditions

The following document details the Terms and Conditions governing your use of the Procreate website. Before using the Procreate website, you must read, understand and agree to these Terms and Conditions. Please read the Terms and Conditions carefully, and also review our Privacy Policy. You can contact us if you have any questions or would like further information.
1) Terminology
The websites located at https://procreate.com and https://folio.procreate.com and all related domains and subdomains ("Site"), are owned and operated by Savage Software Group Pty. Ltd. ("we", "us" or "Savage"), an Australian private company.
The Site is accessed by you ("you") under these Terms and Conditions ("Terms").
In these Terms:
"Intellectual Property Rights" means any patent, registered design, trademark or name, copyright or other protected right.
"Moral Rights" means the:
- right of attribution of authorship;
- right to prevent false attribution of authorship; and
- right of integrity of authorship.
Other capitalised terms are as defined throughout these Terms.
2) Site Use
These Terms constitute a legally binding agreement between you and us, which governs our relationship with you in relation to the Site. By accessing the Site, viewing any content or using any services available on the Site you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not access the Site.
3) Site Users and Members
You may access the Site either with or without signing up for a Procreate account ("Account"). In these Terms, Site users without an Account are referred to as "Users" and Site users with an Account are referred to as "Members". Both Users and Members are bound by these Terms to the extent applicable.
Users may access the Site in a view only capacity, with the exception of the Procreate Support Service. Users may view content and Discussion Boards on the Site but cannot create or share content or otherwise interact with Users or Members on the Site.
Both Users and Members may use the Procreate Support Service, which consists of an online contact form.
Members may make use of the Services available through the Site, as defined and detailed in clause 6 below.
4) Eligibility for Membership
By registering as a Member by creating an Account, you represent and warrant to us that:
- you have read, understood and agreed to these Terms and our Privacy and Cookie Policy;
- you are an individual who can form a legally binding contract at law; and
- you are at least 16 years old.
Minors over the age of 16 can be Members but are restricted from viewing Artwork marked as Mature Content.
5) Account, Username and Password
You must select a unique username for your Account. You must not use a username that is, at our sole discretion, vulgar, offensive, defamatory, obscene, hateful or otherwise unlawful or objectionable. We may modify or void usernames as we see fit.
You must keep your password secure and confidential.
You are solely responsible and liable for all activity conducted through your Account. If you become aware of or reasonably suspect any security breach, including any loss, theft or unauthorised disclosure or use of your password, you must immediately report the actual or suspected security breach to us by contacting us.
All information you provide to us must be true, complete and current, and you must update this information as necessary to keep it true, complete and current.
6) Services
The use of Procreate Folio constitutes the "Services" available to Members through the Site, which includes the ability to:
- share artwork created using the Procreate App ("Artwork") on Procreate Folio;
- comment on Artwork shared by other Members and respond to comments on your Artwork;
- participate in discussions on the discussion boards available on the Site from time to time ("Discussion Boards"), which include:
- Ideas & Suggestions;
- Help & Support;
- Stories;
- Marketplace;
- General;
- Artists' Advice;
- Resources;
- Hardware & Accessories.
Comments on Artwork and contributions to Discussion Boards, both of which include all text, images and links to the Site and third party websites, as well as any text or files submitted through the Procreate Support Service, are referred to as "Content" in these Terms.
7) Rules
Whenever you access, use, or otherwise deal with the Services or the Procreate Support Service, you must comply with:
- these Terms;
- all applicable laws and regulations;
- all acceptable-use policies and other policies implemented by Savage with respect to the Site or the Services from time-to-time; and
- all other rules and policies or procedures that Savage communicates to you from time-to-time, including communications via email or by posting on the Site.
8) Privacy
Without limiting anything in these Terms, you must comply with all applicable privacy laws and must not collect, use, retain or disclose any third party's personal information without their consent unless otherwise permitted by law to do so.
Your privacy is of utmost importance to us. Please view our Privacy and Cookie Policy for details on how we collect and handle the information you provide to us.
9) Artwork and Content Restrictions
Any Artwork or Content which violates any part of these Terms is subject to deletion at our exclusive and absolute discretion. We may also exercise our right to modify Artwork or Content to remove offending text or imagery, or temporarily hide Artwork or Content from the Site pending further action.
Violation of these Terms may also lead to the banning of your Account or IP address/es, and/or proof of illegal activity being passed on to relevant authorities.
10) Prohibited Content
You must not communicate, post, promote, or endorse any Artwork or Content on, via, or in connection with the Site or to Procreate which could be construed as:
- violating any law;
- giving rise to any civil, criminal or other liability;
- impersonating another person;
- representing or referencing illegal drugs, weapons, gambling or other illegal substances, items or activities;
- malicious;
- disrespectful;
- misleading;
- deceptive;
- hateful;
- defamatory;
- obscene
- threatening;
- abusive;
- harassing;
- harmful;
- invasive of anyone's privacy;
- pornographic;
- excessive, extreme or gratuitous sexualisation; or
- excessive, extreme or gratuitous violence, or which is generated using artificial intelligence.
("Prohibited Content").
For the avoidance of doubt, a link to a third party website containing Prohibited Content is in itself Prohibited Content.
Prohibited Content is not permitted anywhere on the Site and may be removed from the Site without warning.
11) Mature Content
"Mature Content" is Artwork or Content which could reasonably be assumed to be confronting to another Member or User, but which is not Prohibited Content. Examples include Artwork or Content which is sexual or violent in nature.
Artwork constituting Mature Content must be marked as Mature Content when posting. Artwork marked as Mature Content is only available to Members over the age of 16 who have "Show Mature Content" enabled in their settings. Artwork marked as Mature Content is not available to Users.
12) Prohibited Actions
You must not:
- reverse engineer, de-compile, hack, disable, disrupt, interfere with, disassemble, copy, decrypt, reassemble, supplement, translate, adapt or enhance any of the Site, the Services, the Savage Property or the Savage Tools (defined in clause 15);
- upload to or transmit from the Site or the Services any data, file, software or link that contains or redirects to a virus, Trojan horse, worm or other potentially harmful component;
- improperly make complaints or false reports on the Site;
- artificially inflate or alter ratings, views or statistics on the Site;
- falsify any data or information available on the Site;
- delete, obscure or modify any copyright or other intellectual property notices on the Site;
- sell or transfer your Account, or allow any third party to access or use it;
- avoid, circumvent, or disable any access control technology, security device, procedure, protocol, or technological protection mechanism that may be included or established in or as part of any of the Site or the Services or any hardware/software used to provide the Site or the Services, or third party hardware/software or services;
- interfere with the Services or any third party's use of the Site or the Services;
- resell any of the Services or allow any third party to use or access the Site or the Services without our prior written consent;
- create any links to any part of the Site unless:
- the link complies with these Terms;
- the link and surrounding materials do not alter the layout, content, look or feel of the Site;
- the link and surrounding materials do not imply affiliation or falsely represent any relationship between the linking site and the Site; and
- the link and surrounding materials do not portray the Site or the Services in a false, misleading, derogatory, defamatory, offensive or otherwise objectionable manner;
- frame or mirror any content contained in, or accessible through, the Site, on any server or internet-based device without our prior written consent; (l) use any data mining, screen scraping or similar software or other data gathering, analysis or extraction tools or processes on the Site without our prior written consent; (m) facilitate, authorise or encourage any third party to do any of the above.
You must not use the Site or the Services to do or attempt to do any of the following without our express prior written permission, which may be withheld or granted at our absolute discretion:
- send spam or other bulk messages;
- engage in phishing;
- gain unauthorised access to any data, network or system;
- conduct or promote any commercial activity, other than on Marketplace in accordance with these Terms;
- gamble;
- monitor data or traffic on any network or system, including the Site;
- obtain an email address, username or other information about a third party without their consent;
- use any misleading, false or deceptive TCP/IP header information in any communication, Artwork or Content; or
- conduct or instigate any denial of service or similar attack against the Site or Savage's network or systems or any third party's website, systems or network.
13) Discussion Board Restrictions
Mature Content is not permitted on any Discussion Board.
Dedicated artwork shares are not permitted on Discussion Boards, unless the artwork is:
- featured and/or referenced as part of a tutorial or guide,
- an example in a request for advice on artistic technique; or
- screenshots or examples that are reasonably necessary for assistance or support.
You can only advertise products for sale under Marketplace and can only advertise free products under Resources.
14) Ownership and Rights in Artwork and Content
Uploading or otherwise submitting or sending Artwork or Content does not give rise to any transfer of ownership in that Artwork or Content. Any Artwork or Content uploaded to the Site remains the property of the relevant owner ("Creator").
You must not do anything that infringes or compromises another Creator's Intellectual Property Rights (including Moral Rights) in any Artwork or Content. This means you must:
- give credit to the Creator (where possible and practicable);
- not say you or another person is a Creator of Artwork or Content if you/they are not; and
- not do something with/to Artwork or Content (such as change or add to it) that would have a negative impact on the Creator's reputation.
You also must not seek to or actually commercially gain from the use of another Creator's Artwork or Content without the express consent of that Creator.
You must not upload the Artwork of another Creator to the Site without their express consent. If the Artwork was not Created by you and/or is not owned by you when you upload it, in uploading the Artwork you must credit the Creator and you warrant to us that you have obtained the necessary consent or licence from the Creator of that Artwork to do so as applicable.
15) Ownership of Savage Property
As between you and Savage, Savage or the relevant third party solely owns the following ("Savage Property"):
- all content on the Site or through the Services, including all text, photos, videos, templates, and other content provided by Savage (collectively, the "Savage Content") and all intellectual property rights in the Savage Content; and
- all tools, hardware and software used to provide the Services (collectively, the "Savage Tools");
- the graphical design of the Site, the Site user interface and the look and feel of the Site and the Site user interface; and
- the names, logos and trade marks of Savage and on the Site (including third parties' marks).
16) Licensing of Artwork and Content
By uploading or otherwise submitting or sending Artwork or Content via the Site, you grant a royalty-free, perpetual, irrevocable, worldwide licence:
- to us (and our third party service providers as applicable) to copy, reformat and distribute the Artwork and Content in connection with providing the Services, including featuring the Artwork anywhere on the Site and sharing the Artwork and Content on social media; and
- to Users and Members to use, communicate share and display your Artwork and Content in accordance with these Terms,
("Licences").
For the avoidance of doubt, where you do not own the Artwork that you are uploading, you must ensure that you are authorised to provide the Licenses to us.
By uploading or otherwise submitting or sending Artwork or Content (including sharing/posting links to third party sites) via the Site, you represent and warrant to us that:
- you have the right to upload the Artwork and grant the Licences;
- the granting of the Licences by you and the use of the Licences by us will not infringe any intellectual property rights (including Moral Rights) of a third party; and
- the file/s uploaded and/or links provided contain no malicious code capable of causing damage to, interference with or unauthorised access to the Site or other Procreate systems or other Users and Members.
By sending Artwork or Content to us for the purpose of obtaining technical support, you grant to us a royalty-free, perpetual, irrevocable, worldwide licence to store and use your Artwork or Content for internal testing and trouble-shooting purposes.
We will contact you seeking your consent if we would like to share or use your Artwork or Content in any context not covered in these Terms.
17) Other Services
If you use any other service or software provided by or through the Site, Savage or the Services, you must comply with the relevant terms and conditions that are imposed upon your use of that service or software as indicated in the relevant part of the Site.
18) Contests
We may provide contests on the Site. If we do, they will be governed by rules we impose upon contestants. If you participate in a contest, you must comply with the rules of that contest. If there is a conflict between these Terms and the rules of a contest, the rules of the contest will govern with respect to that contest to the extent of the inconsistency.
19) Hardware, Software, and Internet Connection
You are solely responsible for obtaining and maintaining all hardware, software and connections required to access and use the Site and the Services.
You must take your own precautions (including antivirus software) to ensure that your access to the Site and Services does not expose you to viruses or other code that is harmful or may assist in causing harm.
Savage will not be responsible for the workings or failures of your hardware, software or Internet access.
20) Cancellation or Suspension by Us
Without limiting any other remedies available to us, we may suspend or cancel your Account or block your IP address/es at any time by notice to you if:
- you breach these Terms or any applicable laws or otherwise violate our rights or those of another User or Member;
- any representations or warranties you have made under these Terms become untrue; or
- we reasonably believe that your actions might cause a legal liability to any other User or Member or us.
In addition to these rights of cancellation and suspension, we may cancel your Account at any time by notice to you, for any reason in our sole discretion.
If we cancel or suspend your Account for any reason, you must not create another Account without our express prior written consent.
21) Cancellation by You
You may cancel your Account at any time by notice to us. Provided we have not cancelled or suspended your account under clause 20, you may create another Account at any time.
22) Inactive and Abandoned Accounts
If you do not log into your Account for any period of at least 365 consecutive days, your Account may be deemed "inactive". We may, in our sole discretion, suspend or terminate your Account if it becomes inactive.
23) Effect of Cancellation
Upon cancellation of your Account or these Terms:
- you will have no further access to your Account, or anything associated with it, other than what is available to Users for viewing;
- we may (but are not required to) delete some or all of your Artwork and/or Content from the Site and from your Account within 60 days after cancellation in addition the other rights of deletion or modification in these Terms;
- the Licences granted in clause 16 will continue in full force and effect for all of your Artwork and Content, including Artwork and Content we delete or modify; and
- clauses 8, 14, 15, 16, 23, 24, 25, 28, 29 will survive termination.
If we block your IP address/es in accordance with these Terms, you must not access or attempt to access the Site, the Savage Content, the Savage Tools or the Services.
24) Warranties and Disclaimers
Any third party websites that are linked from the Site are not under our control, and we do not assume any responsibility or liability for any communications or materials available at those linked sites, or personal information collected about you from those sites. You may be charged fees to access or use the linked sites. All links are provided for your convenience only; they are not an endorsement or referral by us.
We do not endorse any Artwork or Content on the Site and will not be responsible or liable for any such Artwork or Content.
To the extent permitted by law, we expressly exclude any liability for any Artwork or Content posted on or made available through the Site or the Services. Other than as required by law, we do not have, and expressly exclude any liability for, any obligation to monitor Artwork or Content for compliance with these Terms. We will remove or restrict access to Artwork or Content where required by law or if ordered to do so by a court. If you notice any Artwork or Content on the Site which you consider to be in breach of these Terms, please contact us at support@procreate.com and we will delete or modify the Artwork or Content as we see fit in our absolute discretion. We may remove or restrict access to any Artwork or Content if we consider it breaches any of these Terms, but we have no obligation to do so.
We do not have any obligation to verify the identity of the Members.
You must not rely on the Site or Services, any information contained on the Site, or the continuation of the Site or Services. You are responsible for keeping back-up copies of all of your Artwork and Content and must not rely on the Site for access or storage. We will not be liable for any loss or damage to any of your Artwork or Content on the Site. We may impose limits on the quantity and size of your Artwork stored on our servers, and the duration your Artwork is stored on our servers, and may charge you fees for exceeding those limits.
We provide the Services using a reasonable level of care and skill but if you are dissatisfied for any reason, then you may cancel your Account at any time in accordance with clause 21.
To the extent permitted by law, we expressly exclude any warranty or representation that the Services and Site will function without interruption or errors. You acknowledge that the Services and Site, including any Content or Savage Content posted on the Site, may be interrupted, or subject to errors, due to maintenance, updates, or system or network failures or other causes.
25) Limitations of Liability
To the extent permitted by law, we will not be liable for any direct or indirect loss or damage that you or others may suffer arising out of:
- the use or inability to use our Site;
- loss of connection or network,
- loss of data or information of any type;
- unauthorised access to or alterations of your Content;
- activities resulting from the loss or misuse of your username, password or other access mechanism; or
- any content, material on, or linked to any third party websites.
Every effort is made to keep our Site up and running smoothly. However, we take no responsibility for, and will not be liable for, the Site being temporarily unavailable due to technical issues beyond our control.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth), or any other applicable law that cannot be excluded, restricted or modified by agreement.
26) Indemnity
You indemnify and hold harmless Savage from and against all damages, liabilities, costs, expenses (including legal fees) that Savage may incur in connection with:
- your Artwork and Content, including claims that your Content or the exploitation of it as permitted by these terms infringes or violates the rights of any third party, including Intellectual Property Rights;
- your use of the Site, the Savage Content, the Savage Tools or the Services; or
- the untruthfulness or inaccuracy of any of your representations or warranties to us; or
- your breach of any obligation, representation or warranty in these Terms, except to the extent that the relevant damage, liability, cost or expense is caused by Savage.
27) Modifications to these Terms
From time to time in our sole discretion we may modify these Terms by emailing you or posting the modified Terms on the Site. You will be bound by the modified terms after the modified terms have been emailed to you, or have been posted on the Site for 30 days. If you do not agree to the modified terms, you may terminate your Account at any time in accordance with clause 21.
28) Governing Law
Savage operates from Hobart, Tasmania, Australia, and makes no representation that the Site is appropriate or available for use in any particular jurisdiction. These Terms will be governed by the laws in effect in Tasmania, Australia. You consent to the exclusive jurisdiction of the Tasmanian courts with respect to any dispute between you and us in relation to these Terms; however, we may apply to a court of competent jurisdiction for interim protection or equitable relief such as an injunction.
29) Disputes with Other Users or Members
You are solely responsible for resolving any disputes you may have with other Users or Members. We may, but are not obliged to, assist you with this.
30) No Waiver
No delay or failure to act by us regarding any default will impair any of our rights or remedies that are not expressly waived in writing.
31) Entire Agreement
These Terms supersede all prior agreements of the parties regarding the Site and the Services and constitute the whole agreement with respect to the Site and the Services.
32) Severability
If and to the extent any provision of these Terms is held illegal, invalid, or unenforceable in whole or in part under applicable law, such provision or such portion of the provision/s shall be void in the jurisdiction in which it is illegal, invalid, or unenforceable to the extent of its illegality, invalidity, or unenforceability, and shall be deemed modified to the extent necessary to conform to the applicable law so as to give the maximum effect to the intent of the parties. The illegality, invalidity, or unenforceability of such provision in that jurisdiction shall not in any way affect the legality, validity, or enforceability of such provision in any other jurisdiction or of any other provision in any jurisdiction.
33) Assignment
You must not assign or sublicense your rights or obligations under these Terms our prior written consent, which may be withheld in our absolute discretion.
